The Policies outlined here form part of the General Terms and Conditions of Equipment Rental..

Definitions:

“MSC (UK) Ltd”

The abbreviated name of Medical Specialties of California (UK) Limited

“MSC (UK) Ltd” or “Medical Specialities of California (UK) Limited”

The company with whom the Hirer Hires the Equipment.

“Penguin Cold Caps”

The trading name of Medical Specialities of California (UK) Limited / MSC (UK) Ltd.

“Hirer” or “User”

The User of the Equipment, its agents, representatives and/or employees.

“Payee”

The person(s) or account(s) that pays for the Rental and/or Shipping of Equipment on behalf of the Hirer.

“Equipment”

This is the Equipment for Hire.

“Rental”

This is the monthly recurring fees payable in advance for the Equipment.

“Zero Rental”

Some goods are shipped with the ordered Equipment for a Zero Rental fee (for example, velcro fastening elastic straps). A return of such goods is a requirement for the return of the Security Deposit.

“Security Deposit”

To protect against Equipment damages beyond ordinary wear and tear, and for the safe return of the Equipment, MSC (UK) Ltd requires a refundable security deposit from or on behalf of the Hirer prior to any shipment of Equipment.

Security Deposit Balance

The Security Deposit less any charges for Damaged or Missing Equipment and any outstanding Rentals due.

“Shipping Agent”

The company that collects and/or returns the Equipment to the Hirer or MSC (UK) Ltd.

“Tracking Number”

The unique reference number provided by the Shipping Agent (allowing for the digital tracking of Equipment)

“Damage”

Damage in this context means any degradation beyond ordinary wear and tear.

“Missing Stock/Equipment”

Any Item of Equipment rented not returned to Medical Specialties of California UK Ltd. (inclusive of Zero rental fee & damaged equipment).

 
Policy: Equipment Rental

  • Equipment Rental is paid by monthly instalments in advance.

  • There is a minimum equipment rental period of one month.

  • Confirmation will be required; that the Hirer has read, understood and agreed to our Rental Agreement, Terms & Conditions and our Disclaimer.

Policy: Equipment Rental Refund in the event of a termination.

  • In the event the Equipment is returned to us within a monthly Rental period, we will refund any unused Rental paid, subject to any Damages or Missing Equipment

  • Equipment Rental is paid by monthly instalments in advance.

  • There is a minimum Equipment Rental period of one month.

  • The Equipment Rental Agreement can be cancelled at any time, subject to the minimum Equipment Rental period.

  • When the Equipment arrives back at our depot the Equipment Rental charges will cease.

  • The digital tracking number provided by the Shipping Agent will be used to determine the Equipment Rental period dates by verifying the Rental Equipment;

    • Outward Hire Date

    • Return Hire Date

Policy: Security Deposit

  • An Equipment Security Deposit is required.

  • This is payable with the Hirer’s first Rental payment.

Policy: Security Deposit Balance

  • We can only calculate the Security Deposit refundable (the “Security Deposit Balance”) when all the Equipment is returned to our Depot (whether Damaged or not, inclusive of Equipment for which there is a zero rental fee). The Security Deposit Balance is the Security Deposit less any charges for Damaged or Missing Equipment and any outstanding Rentals due.

  • The return of Equipment will be evidenced by the digital tracking number included in the receipts from the Shipping Agent.

  • The Security Deposit Balance will be refunded to the Payee within one month of the Hirer’s account being reconciled. We cannot refund any Security Deposits held unless all the Equipment is returned to our Depot.

  • Damage in this context means any degradation beyond ordinary wear and tear. We monitor the condition of all Rental Equipment shipped to users and received back.

Policy: Settlement of Account

  • We aim to settle your Rental account within 30 days of the return of all Equipment. Any Refund of;

    • excess Rentals paid in advance, and

    • the Security Deposit

    shall take place as part of the Rental account closing process.

  • MSC (UK) Ltd makes best efforts to meet this timeline, however, timeliness is also dependent on policies in place at your payment processor such as your credit card company or bank. You can request a statement if one has not been sent to you.

Policy: Shipping (Delivery)

  • If the Hirer is using their own Shipping Agent, the Hirer will be responsible for any shipping costs incurred.

  • The Shipping Agent used will/must have A Digital Tracking Number Facility.

  • The shipping facility is door-to-door.

  • Shipping costs will vary in accordance with the Shipping Agents; charges, delivery distance and the shipping method used (e.g; overland, by air, overnight).

  • We will authorise our depot to commence the shipping of the Hirer’s order when;

    • the first Equipment Rental and Security Deposit payments have cleared and

    • (if applicable) when we are in receipt of the Hirer’s Shipping Agent account details. (The account number is necessary to facilitate your order.)

  • Every effort will be made to the best of our ability to ensure the Hirer is in receipt of the Rental Equipment prior to the Hirer’s first chemotherapy infusion date.

  • Rental Equipment orders can be subject to stock availability and an appropriate pick-up and delivery slot by the Shipping Agent.

  • Penguin Cold Caps will inform the Hirer if there are any problems with stock availability following the final submission of the On-line order form.

  • Penguin Cold Caps Rental Equipment is the responsibility of the Hirer, from; the Outward Hire Date, until; the Return Hire Date.

  • Penguin Cold Caps do not require the return of the Rental Equipment after each treatment or between usages.

  • Instructions about how to return the Equipment can be found in our Support Literature sent along with the Hirer’s Rental Equipment order. Additionally, when the Hirer wishes to return the Equipment simply email support@penguincoldcaps.com requesting the returns instruction.

Policy: Shipping Costs Refund/Dispute

  • (if applicable) Penguin Cold Caps are not responsible for, or party to; the agreement between the Shipping Agent and the Hirer.

  • Penguin Cold Caps requires the Shipping Agents Digital Tracking numbers to be disclosed in order to track the movement of all orders.

  • All shipping costs are the responsibility of the Hirer and Penguin Cold Caps is not liable for shipping charges or their refund.

  • Shipping Charges and Shipping Refunds are subject to the policies of the shipping agent. e.g. Fed Ex

  • When the Equipment is collected from our depot by a Shipping Agent e.g. Fed Ex, the liability of the Equipment becomes the Hirers responsibility.

Policy: Dry Ice

  • (if applicable) The Hirer who uses Dry Ice:

  • must ensure that the safety advice and instructions are provided by the Dry Ice supplier at the point of Dry Ice purchase.

  • must undertake to adhere to all the advice and instructions provided by the Dry Ice Supplier when storing, transporting, or handling Dry Ice. Particularly the suppliers instructions should highlight that care is needed in the adequate ventilation of environments where Dry Ice is stored or transported.

  • We recommend, additionally to the Dry Ice Suppliers instructions, that when transporting Dry Ice in a vehicle, that the window(s) is always cranked down to allow ‘fresh air’ ventilation.

  • MSC UK Ltd is not liable for any improper use, injury or damage arising from the Hirers’ failure to adhere to the instructions provided by any Dry Ice supplier.

  • Privacy (& Cookie) policy

    This privacy policy sets out how Medical Specialities of California UK Ltd uses and protects any information that you give Medical Specailties of California UK Ltd when you use this website.
